My School 2.0 Update
Following changes to My School in line with recommendations of the ACARA working party set up by the then Education Minister Gillard to address teacher concerns about the misuse of data presented on the site, the My School 2.0 website went live on December 2nd. Key among the changes to the site has been the introduction of Terms of Use agreement for every visitor which makes it an infringement of copyright to produce lists of comparative school performance data. Prime Minister Gillard has not commented on how the copyright provision would be used should there be a perceived infringement, so it remains to be seen whether it has any legal enforceability.
If a media outlet proceeds to publish school league tables following My School 2.0 going live the Federal Government will have to take action against them under copyright law. If it fails to do so then the Prime Minister has not lived up to her undertakings following the working party recommendations.
